Terms of Service

1. Agreement to Terms

By accessing and using Stay in Touch ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on the Stay in Touch application for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer, disassemble, or decompile the software
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. Service Description

Stay in Touch is a Customer Relationship Management (CRM) platform designed to help users manage contacts, companies, communications, and deals. The Service includes:

• Contact and company management
• Integrated messaging (WhatsApp, LinkedIn, Email)
• Deal and pipeline tracking
• Team collaboration features
• Reporting and analytics
• Calendar and scheduling

4. Account Registration

To use certain features of Stay in Touch, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Accept responsibility for all activities under your account
• Maintain only one account per person (not sharing accounts)
• Notify us immediately of unauthorized account access

5. Acceptable Use

You agree that you will not use Stay in Touch to:

• Send unsolicited commercial messages or spam
• Scrape or extract data beyond normal CRM use
• Access or search the Service through automated means (bots, scrapers, crawlers)
• Reverse engineer or attempt to gain unauthorized access
• Upload malware, viruses, or harmful code
• Violate any applicable laws or regulations
• Harass, abuse, or threaten other users
• Infringe on intellectual property or privacy rights

6. Pricing & Payment Terms

Free Trial

All paid plans include a 14-day free trial with full access to all features. No credit card is required to start. See our Pricing page for current plans and limits.

Paid Plans

• Paid Plans: current pricing is set out on our Pricing page (stayintouch.uk/pricing). Plans are billed monthly or annually.
• Payment processed through Stripe
• Billing occurs automatically on renewal date
• You can view and manage your subscription in your account settings

Cancellation & Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• No refunds for partial months unless required by law
• Upon cancellation, access to paid features ends at the end of the current billing period
• You may export your data at any time before or within 30 days after cancellation

Price Changes

We may change our pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of new pricing. Customers on monthly billing will see price changes on their next renewal date.

7. Your Data & Content

Data Ownership

You retain full ownership of all data you upload to Stay in Touch, including contacts, companies, messages, and notes. You grant us the right to:

• Store and process your data to provide the Service
• Access your data to support, maintain, and improve the Service
• Comply with legal obligations

Data Rights

• We do not sell, trade, or rent your data to third parties
• We do not use your contact data for marketing purposes
• You may export or delete your data at any time
• Upon account deletion, your data is securely erased (with backup retention up to 90 days)

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STAY IN TOUCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. STAY IN TOUCH MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify, defend, and hold harmless Stay in Touch and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms of Service
• Your use of the Service
• Your content or data uploaded to the Service
• Your violation of applicable laws

11. Termination

Stay in Touch may terminate or suspend your account at any time for:

• Violation of these Terms of Service
• Non-payment of subscription fees
• Illegal activity or misuse of the Service
• Discontinuation of the Service

Upon termination, your right to use the Service ends immediately. You may request a data export within 30 days of termination.

12. Changes to These Terms

Stay in Touch reserves the right to modify these Terms of Service at any time. Changes become effective upon posting to the Service. Material changes will be communicated via email. Continued use of the Service after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United Kingdom, and you irrevocably submit to the exclusive jurisdiction of the courts in England.

14. Dispute Resolution

Before initiating legal proceedings, we encourage you to contact us to resolve any disputes. If a dispute cannot be resolved through good faith negotiation, either party may pursue legal remedies in the courts of England.

15. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
